Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using Cricsnaps (the "App"), provided by its owner ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of the terms and conditions, you are strictly prohibited from using the App. We reserve the right to update these Terms at any time; continued use constitutes acceptance of those changes.

2. Eligibility

You must be at least 13 years of age to use the App. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract.

3. Account Registration and Security

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information. You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User-Generated Content (UGC) Policy

The App allows users to upload short-form sports videos (up to 30 seconds), titles, and descriptions ("User Content").

• Pre-Moderation: All User Content is subject to manual approval by our moderation team before it becomes visible to the public. We reserve the right to reject, refuse to post, or remove any User Content at our sole discretion.
• Zero Tolerance for Objectionable Content: You are strictly prohibited from uploading content that:
  • Contains nudity, sexually explicit material, or pornography.
  • Promotes violence, physical harm, self-harm, or animal cruelty.
  • Constitutes hate speech, harassment, bullying, or intimidation.
  • Is illegal, fraudulent, defamatory, or misleading.
  • Infringes on the intellectual property rights of others (including unauthorized broadcast footage or copyrighted music).
• License Grant: You retain ownership of your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and display your content in connection with the App and our business operations.

5. Community Guidelines & Interactions

Users may interact with approved User Content via predefined graphical reactions (e.g., "Fire," "Like"). Text-based commentary is disabled by design. You agree not to manipulate the reaction system using automated means, bots, or coordinated artificial engagement.

6. Expert Rating System

The App features an "Expert Rating" system where designated experts may evaluate User Content. These ratings are subjective opinions provided for informational and entertainment purposes only. We make no warranties regarding the accuracy, fairness, or consistency of these ratings, and no user is guaranteed to receive an expert rating.

7. Reporting, Blocking, and Enforcement

To ensure a safe environment, the App provides built-in mechanisms for users to:

• Report: Flag specific videos or user profiles that violate these Terms.
• Block: Prevent specific users' content from appearing in your feed.

We will review all reports and may suspend or permanently terminate the accounts of users who violate our UGC policies.

8. Intellectual Property Rights

Excluding your User Content, all materials contained in the App, including software, code, UI/UX, logos, and trademarks, are the exclusive property of CrickSnaps owners or our licensors. You may not reverse-engineer, decompile, scrape, or extract data from the App.

9. Copyright Infringement (DMCA Policy)

We respect intellectual property rights. If you believe your copyright has been infringed by content on the App, please submit a written notice to our designated Copyright Agent at [DMCA Email Address] containing: (a) a description of the copyrighted work; (b) the location of the infringing material; (c) your contact information; and (d) a statement under penalty of perjury that you are the copyright owner or authorized to act on their behalf.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CrickSnaps owners BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP.

12. Indemnification

You agree to indemnify, defend, and hold harmless CrickSnaps owners, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Karnataka/India, without respect to its conflict of laws principles. Any legal action or proceeding related to the App shall be brought exclusively in the courts located in Karnataka/India.
